Policy and Powder

Link to the rule change

  • Origin and Purpose:
    • The rule change is a part of ATF’s notice of proposed rulemaking (NPRM) 2022R-17, which was signed by the Attorney General on August 30, 2023.
    • It’s intended to implement the provisions of the Bipartisan Safer Communities Act (BSCA), enacted on June 25, 2022.
  • Expanded Definition:
    • The BSCA expanded the definition of engaging in the business of firearms dealing. It now covers all persons who devote time, attention, and labor to dealing in firearms as a regular course of trade or business, primarily to earn a profit through the repetitive purchase and sale of firearms.
  • Licensing and Background Checks:
    • This new regulation clarifies the circumstances under which a person is considered “engaged in the business” of dealing in firearms. Those who meet this definition are required to obtain a license and run background checks.
  • Profit Motive:
    • The rule aims to clarify what it means for a person to be “engaged in the business” of dealing in firearms, particularly focusing on the intent to “predominantly earn a profit” from the sale or disposition of firearms.
  • Impact on Dealers and Auctioneers:
    • The term “dealer,” including its application to auctioneers, is also clarified under the proposed rule.
  • Closing Loopholes:
    • The rule is expected to close potential loopholes that previously allowed individuals to avoid background checks. It will require anyone who sells firearms to earn a profit to register as an FFL (Federal Firearms Licensee) and perform background checks.

This proposed rule marks a significant change in how firearm dealing is regulated, especially focusing on the profit motive and closing loopholes in the background check process. It seems to be aiming for more stringent control over who can legally sell firearms and under what conditions.

Possible comments:

  • Impact on Law-Abiding Citizens:
    • “This rule risks classifying ordinary citizens as dealers for simply selling a few personal firearms. It imposes undue burdens on law-abiding gun owners, complicating legitimate transactions without clear benefit. Such overreach can turn regular Americans into unintentional lawbreakers.”
  • Ineffectiveness Against Criminal Activity:
    • “Criminals don’t follow laws; adding more regulations won’t change that. This rule targets regular gun owners instead of addressing actual criminal activity. We need solutions that focus on crime, not hindering lawful gun owners.”
  • Unnecessary Complexity:
    • “The proposed definition of ‘engaged in the business’ adds unnecessary complexity and confusion for everyday gun owners. It creates a vague threshold that could inadvertently penalize normal, occasional sales. Clear, simple guidelines are needed, not overbearing regulations.”
  • Potential for Unintended Consequences:
    • “While well-intentioned, this rule may have unintended consequences, deterring law-abiding citizens from lawful gun sales due to fear of regulatory violations. It’s crucial to ensure regulations protect rights without placing unwarranted burdens on law-abiding Americans.”
  • Questioning Rule’s Effectiveness:
    • “Question the effectiveness of this rule in stopping illegal gun trafficking. It seems to place more restrictions on lawful sellers than on those who operate outside the law. Effective gun control should target illegal activities, not regular citizens.”

Ryan W:

Good day WLS,

I have my first two suppressors sitting in jail. They are the Vers 9 and the Icon from Bowers Group. I’m thinking about getting a can for a 10.5″ AR pistol. From the Bowers group website, it seems that they all say they are not rated for mag dumps with 5.56/.223. I have a binary trigger in my pistol and love to do mag dumps. What do you guys recommend? I want to go with a reputable company that backs up their suppressors with a good warranty/service plan. Love the show. Thanks.

Paul S:

A follow up question to add onto my previous question about the perfect lever gun….

It seems like I want to take 2 different guns parts, mold them together into 1.

Like the curved grip of the Henry Big Boy X and it’s threaded muzzle, but the walnut stock and forearm of the brass framed Henry.

Is there any other guns you would like to also do this with?

I guess PCCs are kinda that….an AR 9mm that takes Glock mags. It’s not a super powerful rifle, but also a very big pistol. It’s like 2 different guns molded into 1.

Alex W:

Hi. What do y’all think is the most affordable PDW sized gun that you would trust for personal defense? Any caliber is fine.

Rob K:

Dear WLS,

I love listening to the podcast and this is my second time writing in to the show! Sadly, I’m always 4 to 6 weeks behind in listening to the episodes because of work, life, and such. I just listened to episode 526 Try Care where Jeremy mentioned that he lost a GunBroker bid on an old bushmaster parts kit with the fixed carry handle. I was ecstatic to find out I was the one that beat out Jeremy that night! I wanted it for the same reason he did for the fix carry handle upper. Great minds think alike on build ideas.

My question to each member is: what are your top three guns that got away from you at an auction that you still think about. My top three are a Vietnamese SKS that sold for $1800, a preban PSL that sold $1100, and polytech type84 in 5.56 that also sold for $1100. Keep up the great work. WLS is life!
